Simple Probate Offer

If you have suffered a bereavement, you may be wondering what to do once you have registered the death of the person who has died. Our lawyers have considerable experience in dealing with bereavements and managing the related legal, tax, property and estate administration.

We now offer a simple Probate service for a fixed price, starting from £3,250 plus VAT for estates under £350,000.

What is simple Probate?

Probate is an umbrella term often used to describe the process of administering a person’s estate. It is a widely used term but Probate (Grant of Representation) is the physical document issued by the Court which gives the power to the Executors to administer the estate. There are various types of applications that can be made for Grant of Representation but for the purpose of our simple Probate service, we are referring to the Grant of Probate which is issued by the Courts where the deceased left a valid Will.

Where the deceased leaves assets exceeding £5,000 Grant of Probate is often needed. When a person dies their accounts and assets are locked and it is the duty of the Executors to unlock these assets so the estate can be administered and distributed in accordance with the Will. Although the executors authority is derived from the Will itself, the Grant of Probate is effectively their key to unlocking the assets.

What is the cost of simple Probate?

Our fixed fee for an estate value up to £325,000, which includes some or all of the assets listed below, is £3,000 plus VAT and disbursements.

  • 1 UK residential property
  • Up to 2 UK bank accounts
  • No estate liabilities other than funeral expenses
  • Up to 5 pecuniary legacies
  • Up to 5 Residuary Beneficiaries

Our fixed fee for an estate valued up to £325,000, which includes some or all of the assets listed below, is £4,200 plus VAT and disbursements.

  • 1 UK residential property
  • Up to 6 UK bank accounts
  • 1 investment portfolio
  • Up to 5 Residuary Beneficiaries
  • Up to 5 pecuniary legacies

Once we have provided you with a fixed fee Probate quote in writing the price will not change unless the original information we are given is incorrect or the circumstances change.

What does the offer include?

The offer includes:

  • A telephone call or Zoom meeting to discuss your circumstances
  • Establishing the value of assets and liabilities
  • Preparing the necessary HM Revenue & Custom forms and submitting the same
  • Making the application for Probate
  • Where applicable placing s27 advertisements
  • Collecting in the assets and settling estate liabilities
  • Preparing estate accounts
  • Calculating and arranging to distribute the estate in accordance with the terms of the Will
  • Reporting and calculating the income tax for the estate administration period to to HMRC on an informal basis
  • Obtaining clearance from HMRC

What the offer does not include

  • Filing of tax returns for lifetime and post death income tax
  • Deeds of Variation
  • Disclaiming any right to inheritance
  • Any disputes or challenges to the Will
  • Any issues arising a result of missing beneficiaries
  • Dealing with domicile issues and foreign assets
  • Any conveyancing work required in selling the house

Our simple probate service assumes that:

  • A valid Will exists
  • The deceased was UK domiciled
  • That the executors named in the Will are happy to take up their appointment
  • That the estate falls within the criteria set out above
